I’m a simple girl. Also, not a lawyer. So it’s simple to me. Criminals can’t possess a gun. People who have come into the country illegally have committed a criminal act and are de facto criminals. Therefore, no 2A rights.
In a case involving an illegal immigrant from Chicago, a three-judge panel of the 7th Circuit Court of Appeals has unanimously ruled that the protections afforded by the Second Amendment do not apply to those in the country illegally.
The case involved Heriberto Carbajal-Flores, a Mexican national who fired a pistol during a Chicago riot in 2020 and, after being arrested, claimed the Second Amendment protected his right to carry a firearm for self-defense. Carbajal-Flores did not dispute that he possessed a firearm that night. And, at the time, he was unlawfully present in the United States.
Consequently, the grand jury indicted him for violating a section of federal law that forbids “an alien” who “is illegally or unlawfully in the United States” from possessing a firearm. While his attorneys made that argument before the court that his firearm possession was protected, the circuit court justices ruled that Second Amendment protection only applies to American citizens.
