7th Circuit: 2A Doesn’t Apply To Illegal Aliens

I’m a simple girl. Also, not a lawyer. So it’s simple to me. Criminals can’t possess a gun. People who have come into the country illegally have committed a criminal act and are de facto criminals. Therefore, no 2A rights.

In a case involving an illegal immigrant from Chicago, a three-judge panel of the 7^th Circuit Court of Appeals has unanimously ruled that the protections afforded by the Second Amendment do not apply to those in the country illegally.

The case involved Heriberto Carbajal-Flores, a Mexican national who fired a pistol during a Chicago riot in 2020 and, after being arrested, claimed the Second Amendment protected his right to carry a firearm for self-defense. Carbajal-Flores did not dispute that he possessed a firearm that night. And, at the time, he was unlawfully present in the United States.

Consequently, the grand jury indicted him for violating a section of federal law that forbids “an alien” who “is illegally or unlawfully in the United States” from possessing a firearm. While his attorneys made that argument before the court that his firearm possession was protected, the circuit court justices ruled that Second Amendment protection only applies to American citizens.
